Mediation Process

In Place of Strife administer my mediations. Details of my fees and availability are available from Jane there on 020 7917 9449 or jane@mediate.co.uk. Alternatively please contact me directly by email or telephone.
- Once the Parties are agreed on my appointment, then a date and venue for the mediation needs to be agreed. If it assists, I can make available meeting rooms and facilities at the offices of my previous firm, Burges Salmon LLP, in Bristol or London at a daily rate to be agreed.
- The terms of the Mediation Agreement need to be agreed. A draft for consideration by the Parties can be downloaded here. Any proposed changes to the draft need to be agreed between the Parties and me. I will bring the agreed version to the mediation day for signature by the Parties.
- Each Party should prepare and provide to one another and me, prior to the mediation day, a concise summary of its position (a "Position Statement"), together with a file of documents it feels is essential for me to read in conjunction with the Position Statement.
- Once the date for the mediation day has been fixed, I will suggest to the Parties a timetable for exchange of Position Statements and accompanying documents.
- Prior to the mediation day, I may communicate with the Parties, jointly or separately, as I think appropriate to ensure an understanding of each Party's position, and to ensure that appropriate arrangements have been made for the mediation day and its smooth running. Until signature of the Mediation Agreement, all such communications are deemed to be covered by the confidentiality provisions of the draft Mediation Agreement.
- In Place of Strife will administer the billing and invoicing of this mediation for me and once the Parties are agreed on my appointment, I will ask In Place of Strife to contact the Parties to deal with those matters.
